Big Rigs Mean Big Wrecks

When drivers of 18-wheelers and big rigs get too tired or are poorly trained, they can and do cause deadly accidents. And when you see trucking companies putting a lot of big rigs on highways running day and night, it’s not surprising that a lot of innocent people get hurt or killed. Driver negligence, poor company policies, and lack of oversight can all play a part. We know how to dig up the dirt on trucking companies.

Common Causes of Truck Accidents

Wrecks involving 18-wheelers and other large commercial trucks can have a variety of causes:

  • Driver fatigue
  • Drug and alcohol use
  • Truck driver negligence
  • Trucking company negligence
  • Dangerous or aggressive drivers
  • Defective truck parts
  • Trucks that do not pass inspections
  • Breaking Federal Motor Carrier Safety Administration (FMCSA) regulations

Trucking Regulations in Texas

Truck drivers in Texas must follow federal and state safety regulations when they are on the road. In addition to the traffic laws that all drivers must follow, there are laws that apply only to the operation of commercial trucks.

The Federal Motor Carrier Safety Administration (FMCSA) establishes nationwide trucking laws, such as hours of service regulations. Hours of service regulations state that truckers are only permitted to drive for a maximum of 11 hours, and only after they have been off-duty for 10 consecutive hours. Once they are on duty for 14 hours, they are not permitted to drive again until they have taken a break. These regulations are in place to minimize the risk of accidents caused by fatigued drivers.

Texas law governs other regulations that truckers in the state must adhere to, including registration rules and vehicle weight limits. Like any vehicle, commercial semi-trucks must be registered. Weight limit regulations in Texas vary depending on the type of vehicle, the cargo being carried, and other factors. Vehicles that are considered oversize or overweight can obtain permits to continue operations. The failure to comply with weight limits can result in truck accidents.

Trucking companies must maintain records to demonstrate compliance with federal and state regulations. Safety violations may be recorded, and could be used as evidence in a truck accident case.

Trucking Company Negligence & Wrongdoing

In many cases, the blame falls on the trucking companies rather than the drivers. It is a company’s legal responsibility to properly train their drivers and ensure they are fully licensed before they hit the road. While there are federal and state laws and regulations that truckers and their companies must abide by, catastrophic accidents do happen. Many of these preventable accidents occur as a result of negligence and failure to properly follow safety rules to keep other motorists safe. To make more money, trucking companies sometimes cut corners and put inexperienced or overworked drivers out on the road before they are ready.
