How to Prove an Illness Is Related to Work

Posted on in Work Place Injuries

Many people know that, when a worker is injured on the job, they can file a workers' compensation claim in order to make up for lost wages and medical expenses related to their injury. But what happens when a worker contracts a disease or falls ill because of their job?

Illnesses and Scope of Employment

Fortunately, Texas workers' compensation laws also apply to illnesses, diseases, and other conditions that are related to a workers' specific job duties. This means that a worker who gets sick on the job can pursue benefits to get the care that they need.

In order to successfully do so, however, an injured worker must prove two things for the case:

  1. The disease was caused by conditions that are characteristic and specific to the workers' job environment or duties

  2. The disease was not an “ordinary disease of life” in which the general public had an equal chance of being exposed to

In other words, there must be a direct link between the particular job and the disease that the worker contracted. The actual evidence needed to prove this link will vary based on the situation and job. For instance, a miner who contracts pneumoconiosis—also known as “black lung” disease—may have a relatively easy time proving that their illness is a direct result of their work. But for other jobs and diseases, it may be more difficult to prove this link.
