According to Sergeant Harold Mallory of the Department of Public Safety, the incident occurred at approximately 9:14 p.m. on February 24. Reports indicate that 33-year-old Adan Martinez of Alice was traveling westbound in a 2017 Dodge Ram 1500 when he collided with a black cow that had wandered onto the roadway. Emergency responders from Allegiance EMS evaluated Martinez and treated him at the scene. Authorities have not released information regarding the cow’s owner or whether any citations were issued. Investigations into the crash remain ongoing.

Our thoughts are with Adan Martinez at this time.

Loose Livestock Laws in Texas

Alice, TX – Car Crash with Cow Reported on FM 665Texas has specific laws regarding loose livestock on roadways. Whether an owner is liable for an accident involving their animal depends on local regulations, as Texas has both open-range and closed-range counties.

Understanding livestock laws is crucial for drivers and animal owners. Here are key points about Texas livestock laws and responsibilities:

  • Open-Range vs. Closed-Range Laws – Texas historically follows "open range" laws, meaning livestock can roam freely unless a county has adopted local restrictions. Many counties, including those with high traffic areas, have passed stock laws requiring owners to fence in their animals.
  • Owner Responsibility – In closed-range counties, livestock owners must ensure their animals are properly secured. If an animal causes an accident, the owner may be held liable for damages if negligence—such as a broken or poorly maintained fence—can be proven.
  • Liability in Accidents – In areas with stock laws, owners may face financial responsibility if their livestock causes injury or property damage. However, proving liability often depends on factors like whether the animal escaped due to owner negligence or an unforeseen circumstance.
  • Reporting Loose Livestock – If drivers spot animals on the road, they should report them to local law enforcement. Loose livestock can be extremely dangerous, particularly at night or in areas with limited visibility.
